No. It helps identify visible risks before filing, but CNIPA makes the final examination decision.
What if the application is refused?
Refusal review is a separate procedure and will be quoted separately after reviewing the official refusal grounds.
What are the applicant’s legal responsibilities?
Applicants must file in good faith and for legitimate business purposes.
Applications may be refused or invalidated if they:
are filed in bad faith without a genuine intent to use;
misappropriate a mark belonging to a principal or business partner; or
prejudice prior rights or pre-empt another party’s previously used mark.
Malicious filings may also result in administrative penalties.
